  • FSSAI stands for Food Safety & Standard Authority of India.

  • The FSSAI has been established under the Food Safety and Standard Act, 2006.

  • FSSAI is responsible for protecting and promoting public health through the regulation and supervision of food and safety.

  • It is mandatory before starting any food business irrespective of being a trader, manufacturer or dealer.

  • FSSAI license is valid for 5 years.

  • Renewal is to be done before 120 days of expiration of FSSAI License.

  • Changes can be made in license by filing the application form again along with separate fees for modification.

  • Returns are applicable for activities related to only manufacturing and  importing.

  • Last date of filing FSSAI return is 31st may every year . In case of non-compliance a penalty of INR 100 /- per day is imposed.

TYPES OF FSSAI

​

There are three different types of food License.

(Based on Turnover other than Manufacturing)

​

  1. Basic Registration: If a particular business expects its annual turnover till 12 lakh rupees then they need to take basic registration.

  2. State Registration: If a particular business expects its annual turnover above 12 lakh and upto 20 Crores or 30 Crores (in case of wholesaler) then they need to take state registration.

  3. Central Registration: If a particular business expects its annual turnover above20 Crores or 30 Crores (in case of wholeseller) then they need to take central registration.

Based on Business Operations

​

In case of manufacturing units:

​

  1. Basic Registration: For manufacturing units where production is not more than 100 kg per day, they need to avail basic registration.

  2. State Registration:  For manufacturing units where production is more than 100 kg/litre to 2 metric tonnes per day, they need to avail state registration.

  3. Central Registration: For manufacturing units where production is more than to 2 metric tonnes per day, they need to avail central registration.

 

  • For Importers: Separate central License shall be applied apart from domestic license( Only  central license).

  • For Exporters: Separate central License shall be applied apart from the domestic license.

(One license cannot be issued for import as well as export. Separate licenses are to be acquired.)

 

For Any Storage Units (cold/refrigerated):

​

  • If any storage unit has storage capacity more than 10000 metric tonnes then they need to avail central license.

  • If any storage unit has storage capacity up to 10000 metric tonnes, they need to avail state registration.

  • If a storage unit has annual turnover up to 12 lakhs/annum, they need to avail basic registration.

For Any Storage (except from controlled atmosphere & cold):

​

  • If any storage unit has capacity more than 50000 metric tonnes, they need to get central registration.

  • If any storage unit has capacity upto 50000 metric tonnes, they need to get state registration.

  • If any storage unit has capacity less than 50000 metric tonnes but turnover up to 12 lakhs/annum, they need to get basic registration.

For Any Storage (having Controlled atmosphere & cold)

​

  • If any storage unit has capacity less than 1000 metric tonnes but turnover up to 12 lakhs /annum, they need to get basic registration.

  • If any storage unit has capacity upto 1000 metric tonnes, they need to get state registration.

  • If any storage unit has capacity more than 1000 metric tonnes, they need to get central registration.

For Food Vending Agencies:

​

  • If the unit has turnover upto 12 lakhs/annum or up to 12 vending machines in one state, they need basic registration.

  • If the unit is having up to 100 vending machines in one state, they need to get state registration.

  • If the unit is having more than 100 vending machines in one state, they need to have central registration.

 

For Hotels:

​

  • Any hotel having turnover up to 12 lakh per annum are eligible for basic registration.

  • Any hotel having one or two star rating or non- star rating and having turnover more than 12 lakh per annum are eligible for state license.

  • Any three or four star (ministry of tourism certified) hotels are eligible for state license.

  • Any hotel having five star or above rating (ministry of tourism certified) are eligible for central license.

For Transporters (Having a number of specialized vehicles license, insulated refrigerated van/wagon, milk trucks etc):

  • The units having more than 100 vehicles /wagons or turnover more than 30 crore are eligible to have central license.

  • The units having up to 100 vehicles /wagons or turnover up to 30 crore are eligible to have state license.

  • The units having less than 100 vehicles /wagons or turnover up to 12 lakhs /annum are eligible to have Basic license.

 

For Ecommerce operators: Who are having their own ecommerce platform are eligible only for central license.

 

Procedure for Obtaining FSSAI License

​

  1. Check Eligibility( Category)

  2. Obtain Documents

  3. Online submission of form with the authority.

  4. Uploading documents

  5. Acceptance of application by department (In certain cases inspection is possible).

  6. Display of certificate

Time required for FSSAI Registration:

​

  • It depends upon the state, some states take longer time to generate certificate.

  • It also depends upon the type of license: basic, state or central.

  • Basic registration takes around 7 to 10 working days.

  • In case of state registration for manufacturing units it takes 1 to 2 months and inspection may also be done, for any other business it takes around 15 to 20 working days.

  •  In case of central registration for manufacturing units it takes 1 to 1.5 months  and inspection may also be done, for any other business it takes around 15 to 20 working days.

Documents Required for FSSAI Registration

​

  • Name of Unit( Restaurants, café etc)

  • ID and Address proof of proprietor/director/partner

  • Email ID ,  contact number , Passport size photo of proprietor/director/partner

  • Details of nominee in case of proprietorship

  • Utility bill of the business premises ( Electricity bill/ phone bill not older than 2 months)

  • If premises is rented then provide rent agreement along with No Objection Certificate ( NOC)

  • CIN, AOA, MOA incase of a company

  • LLP deed or partnership deed.

  • Annual turnover details.

  • For manufacturing unit addition details like: trade license, site plan, photograph of unit, water testing report,certified ID, Address proof & Degree ( BSc or MSc in chemistry of one competent person in case of manufacturing unit.
